EMAIL COMPLIANCE POLICY (ECP)

1. Purpose

This Email Compliance Policy governs the use of email functionality within RevuSend.

RevuSend enables users to send review request and related communications. Users are solely responsible for ensuring that all communications comply with applicable laws and regulations.

2. User Responsibility

Users are fully responsible for:

  • The content of emails sent through the Software

  • The legality of contact lists uploaded

  • Compliance with all applicable email and privacy laws

  • Honoring opt-out requests

  • Maintaining accurate sender identification

Bright Stacker does not review, pre-approve, or monitor individual messages.

3. CAN-SPAM Compliance (United States)

Users sending emails to recipients in the United States must comply with the CAN-SPAM Act.

Each email must:

  • Accurately identify the sender

  • Use truthful and non-deceptive subject lines

  • Clearly disclose that the message is a business communication when required

  • Include a valid physical mailing address

  • Provide a clear and functioning opt-out mechanism

  • Honor opt-out requests within legally required timeframes

Failure to comply may result in account suspension.

4. GDPR and International Compliance

Users sending communications to individuals located in the European Union or other regulated jurisdictions must ensure:

  • Lawful basis for processing personal data

  • Proper consent where required

  • Compliance with applicable data protection laws

  • Respect for data subject rights

Bright Stacker acts solely as a service provider and does not determine lawful basis for user communications.

5. Prohibited Email Practices

Users may not use RevuSend to:

  • Send unsolicited bulk email

  • Use purchased, scraped, rented, or harvested email lists

  • Send deceptive, fraudulent, or misleading messages

  • Impersonate another person or business

  • Circumvent opt-out mechanisms

  • Continue contacting recipients who have unsubscribed

Violation of these rules may result in immediate termination.

6. Opt-Out and Unsubscribe Obligations

Users must promptly honor any request from a recipient to stop receiving communications.

RevuSend users are responsible for maintaining suppression lists where required.

Failure to honor opt-out requests is strictly prohibited.

7. Deliverability Disclaimer

Bright Stacker does not guarantee email deliverability, inbox placement, open rates, or response rates.

Email performance depends on numerous factors outside our control, including:

  • Sender reputation

  • Recipient email provider policies

  • Content quality

  • Domain configuration

  • Third-party service limitations

8. Abuse Monitoring

Bright Stacker reserves the right to:

  • Investigate suspected misuse

  • Request documentation of consent

  • Suspend or terminate accounts engaging in abusive or unlawful practices

We may take action without prior notice if we reasonably believe violations have occurred.

9. Indemnification

Users agree to indemnify and hold harmless Bright Stacker from any claims, fines, penalties, damages, or liabilities arising from:

  • Violation of email marketing laws

  • Improper use of contact data

  • Unlawful communications sent through the Software

10. Incorporation into Terms

This Email Compliance Policy is incorporated into and forms part of the Bright Stacker Terms of Service.

Use of RevuSend constitutes agreement to this Policy.
