ACCEPTABLE USE POLICY (AUP)

This Acceptable Use Policy (“AUP”) outlines the standards for using Bright Stacker’s services, including the RevuSend software platform and all supplemental physical materials provided by the Company. By using our services, you agree to comply with this policy.
This Acceptable Use Policy governs use of RevuSend, GTRmode and all Bright Stacker products.
By using the Software, you agree not to:
A. Send unsolicited bulk email (“spam”) in violation of applicable laws.
B. Upload contact lists obtained without lawful consent.
C. Use purchased, scraped, or harvested email lists.
D. Send deceptive or misleading communications.
E. Violate CAN-SPAM, GDPR, CCPA, or other data protection laws.
F. Impersonate another individual or business.
G. Use the Software for unlawful, fraudulent, or abusive purposes.
H. Attempt to interfere with the integrity or security of the Software.
I. Upload malicious code.
J. Circumvent subscription limits.
1. Digital Communications
When using the RevuSend platform to request customer feedback or reviews, you must adhere to the following standards:
Regulatory Compliance: You agree to comply with all applicable communication and privacy laws, including the CAN-SPAM Act, GDPR, and relevant state regulations.
Permission-Based Contact: You must only send communications to customers who have an existing business relationship with you or have explicitly consented to receive such communications.
Prohibited Content: Sending unsolicited mass-marketing, “spam,” or deceptive communications through our platform is strictly prohibited. You are solely responsible for the content and legality of all emails sent via your account.
2. Physical Materials
For subscription plans that include physical materials (e.g., custom review cards), you agree to the following:
Prohibited Use: You shall not use any physical materials provided by Bright Stacker to facilitate fraudulent, deceptive, or misleading practices.
Integrity of Feedback: You may not use these materials to manipulate public review platforms through incentivized, coerced, or fake reviews.
Misrepresentation: You must not distribute materials that misrepresent the nature of your business, the services provided, or the authenticity of the feedback being solicited.
Legal Compliance: You may not use branded materials to promote illegal activities or content that violates applicable local, state, or federal laws.
3. Prohibited Conduct
You agree that you will not use our services to:
Interfere with, disrupt, or attempt to gain unauthorized access to our platform or third-party integrations (e.g., Glide, Make.com, Zoho).
Upload, transmit, or distribute any malicious code, viruses, or disruptive software.
Impersonate any person or entity, or falsely state your affiliation with any person or entity.
Harass, threaten, or defraud any individual or organization.
4. Consequences of Violation
Bright Stacker reserves the right to monitor account activity for compliance with this AUP. We reserve the right to suspend or terminate your account immediately, without refund or notice, if we determine that you have violated any provision of this policy.
5. Updates to Policy
We may update this AUP from time to time. Continued use of our services after such changes constitutes your acceptance of the updated policy.
Email Compliance Requirements
Users of RevuSend agree to comply with the CAN-SPAM Act and all applicable email marketing regulations.
Each email sent using the Software must:
• Accurately identify the sender
• Contain truthful subject lines
• Include a valid physical mailing address
• Provide a clear method to opt out of future communications
• Honor opt-out requests promptly
Bright Stacker does not monitor individual messages and assumes no responsibility for user violations of email laws.
Users assume full legal responsibility for compliance.
Bright Stacker reserves the right to suspend or terminate accounts that violate this policy.
Users are solely responsible for the legality of their communications.
